Project Summary

The project will be implemented in the form of a workshop held in the margins of EC1 meetings in Peru in 2016 to build awareness of and to share experience among APEC economies in the application of the United Nations Commission on International Trade Law (UNCITRAL) Model Law on International Commercial Arbitration for efficient settlement of business disputes and to enhance understanding on some practical issues in the use of alternative dispute resolution including choosing the seat of arbitration and the governing law for the dispute, the general requirements for an arbitration agreement, the choice of arbitration institutions/arbitrators, the conduct and procedures of arbitration proceedings, legal representation of parties, provisions on interim relief, recoverability of legal costs, enforcement of arbitral awards and the role of mediation.

The project seeks to advance structural reform and to strengthen the economic and legal infrastructure of member economies.  Outcomes of the workshop will be compiled into a report, allowing key lessons learnt to be broadly shared among APEC economies and the international community.
